Conservation Area Management Plan

This will be a useful development control tool. It represents an opportunity for local people to drive the agenda. It follows on from the Conservation Area Appraisal last year.  It should consider where things are going well and where there are issues; it should look for active conservation and improvements and define who is responsible.

Will be useful to update the Village Design Statement within the context of the Local Development Framework process.

RB has received a list of all listed buildings from ESBC.

English Heritage ‘Streets at Risk’ contains various checklists that can be downloaded, and information on how to do a street audit.

Agreed to hold a Saturday community involvement day to do information collection – groups would look at different aspects:

- Listed buildings and their context

- Street furniture

- Signage

- Trees / hedges

- other built environment, including walls etc

- roads, footways, kerbs

- traffic impact – noise / air quality

Possible date for the event – Saturday 17th October.

Things to do:

- Inform residents of listed buildings.

- Obtain details of tree preservation orders.

- Obtain plan of revised Conservation Area.

- Maps and plans for recording information on.

- Cameras

- People to do refreshments on the day.

- Data projector

- Ask Civic Society to be involved

School drop off area / Newbold Quarry

 Estimated to be £1m + scheme. Further meeting of interested parties has been held. Landowner likely to want to get permission for some housing in exchange for giving land for drop off point.

 Establish whether Aggregate Industries are pursuing the Environmental Assessment at present.

Funding opportunities

A couple of funding opportunities have been identified:

- English Heritage – Heritage Lottery Fund – can apply on-line.

- Local Community Fund – each County Councillor has been given £10k to spend on local projects

Transport & Environment – Drakelow Park.

In very general terms, there has not been much progress to report because the planning application is still being considered in detail, particularly by the highway authorities and bodies such as the Environment Agency. An extension of the time limit to determine the application has been agreed to the end of October and the Highways Agency has issued a holding direction, which means that SDDC cannot determine it until such time as they have made comments. The meeting briefly heard an update on both the planning and transport issues. A number of issues particularly regarding transport impact were raised, although many just repeated arguments from the last meeting. We will not know much more until the highway authorities in particular have made their responses.

Planning update -

Three planning applications were submitted in May this year :-

- a pedestrian and cycle bridge - submitted to both ESBC and SDDC - there have been objections from the Police on security grounds and so the application has been withdrawn so as to review these issues, before resubmitting;

- listed building consent for a stable block;

- the main application for a residential led mixed use scheme, which includes two main residential areas of approximately 2200 homes, a new employment park and new green infrastructure (I think they mean open space !!). It is essentially being promoted as a new community to meet the housing needs of Burton and South Derbyshire, which brings brownfield land back into use.

This application has gone past the time limit for determining major applications but an extension has been agreed with SDDC until 27th October.

One main issue raised in response to this planning update was regarding the impact on the Trent Valley in terms of flood risk. Concern was expressed that the current washlands were unable to cope and that the Walton on Trent bypass would act as a dam. In response, the consultants stated that very detailed work had been undertaken with the Environment Agency. The Agency has submitted an objection, but the consultants understand that this really relates to relatively minor issues. Flood mitigation measures are in the process of being constructed for the e-on development. The consultants responded that the flood risk associated with the Walton bypass had been dealt with at the time of that application being considered and the Inquiry and the Environment Agency concerns had been met.

e-on proposal

- proposals for power stations are determined by the Secretary of State. He will consult widely and then consider the responses and eventually reach a view. The relevant local authorities have made no objections to the proposal, so the matter now rests with the Secretary of State. 

 Transport update

Highway issues for this proposal are complicated by the fact that three highway authorities are involved, Derbyshire and Staffordshire CC's and the Highway Authority for the trunk road impact. The Highways Agency has issued a holding direction which prevents SDDC from determining the application until such time as the Highways Agency has had the time to consider the proposal. This is perfectly normal for major applications of this nature. The consultants have given additional information to the authorities as requested and are now awaiting the response. The consultants did state that they were having a debate about the timing of the construction of the Walton on Trent bypass - whether work needs to have started before work starts on Drakelow or whether it can be triggered by the construction of a certain number of houses. Staffordshire CC has apparently requested that the development assesses the need for a third crossing of the Trent. The consultants' response is that they won't do this because there is no proposed route which has the approval of the responsible body for them to consider.

 Issues raised in response included :-

- the status of the proposed route from the A38 to A444 - A scheme was looked at about 5 years ago on behalf of Staffs CC. The conclusions were that there was little benefit for Burton, but it could benefit redevelopment albeit on a significant scale, but there remains no approved scheme for either a third crossing or this link road.One of the issues about the proposal is a policy one - the Government has stated that building new roads should be a last resort, after all other opportunities to improve the sustainable transport have been exhausted.

- rat runs on the surrounding roads, if the above proposal isn't promoted - response - the Walton on Trent bypass is a permitted scheme and the impact on existing roads was dealt with at the time of the Inquiry. If there is to be a third crossing, then this is something for the authorities and the consultants would be happy to talk if ever there is a firm proposal. 

- impact on routes to Swadlincote, with various ideas being mentioned - response from developers was that they have put forward what they considered reasonable in terms of what impact the development would have on local roads and it was now up to the responsible highway authorities to respond. If they didn't like what was proposed then the application may be refused on transport grounds and transport issues would be debated at length at any Inquiry

I could have contributed - but didn't - and there was also an impact on surrounding villages, but this point was made quite clear at the last meeting and we also made it in our objection. I didn't believe it was necessary to revisit it here, especially as we still don't know yet what Staffordshire CC is saying and as the Chair has specifically requested that we don't revisit old issues.

Eon Street lighting

Martin Beavis (Eon) to be invited to next meeting to discuss proposals. PH to ask him for more details of scale and scope of proposals, further copies of plans, key to plans, photos of other village lighting schemes.

Once Committee has agreed type / style, Eon will model the lighting scheme and determine whether any columns need to move. Agreed that proposals would be consulted upon with public exhibition.

Newbold Quarry

There has been a request for views on the environmental scoping by 1st June 2009. Following which there will be a full Environmental Impact Assessment to go in with the planning application, which is now likely to go forward next year.

ES has already suggested to Aggregate Industries that it does seasonal surveys this year, to enable it to provide fuller information on the ecology aspects.

It was agreed that Gerry Peck be asked to make a response on the following basis:

bullet Document appears to be competent in respect of coverage of the various issues and we note that the Parish Council’s previous comments have been taken into account. Clearly it remains to be seen how fully each of these will be addressed by the assessment.
bullet Application to SCC would seem premature, given that the Minerals Strategy is still being drafted.
bullet Given the reduced demand for gravel, to what extent does additional gravel extraction need to be concentrated on the Barton area?
bullet Consideration should be given to rail freight and the transport of infill by canal.
bullet A landscape character assessment should be undertaken.
bullet Secondary impacts of the quarry extension should be considered, including traffic impacts on the village and surrounding area.

ESBC LDF Housing Sites Applications

A number of potential sites in Barton are included. All members to review sites on website and make comments (see on-line questions for types of issues to consider) to ES as soon as possible, in order that a decision on the Parish Council’s response to ESBC can be made at its June meeting.

Drakelow Park

It was noted that applications had been submitted to SDDC for extensive development at Drakelow Park and for a foot / cycle bridge over the Trent from the site to Branston Golf Club. The consultation periods run until 26th May and 5th June respectively. (There is also a further application in respect of the gas-fired power station on the Council’s website).

These developments will clearly impact on Barton, yet the Parish Council has not been formally consulted. Gerry Peck to be asked to submit a response to SDDC by 26th May with words to the effect:

bullet Previous comments have been made to SDDC on these proposed developments, which will impact on Barton, but the Parish Council has not been formally consulted. Given this position, and the fact that the PC has only just found out about the applications, we would ask SDDC for an extension of the consultation period, so that full and proper consideration can be given to the very extensive proposals.

ES to ask Peter Jepson to activate cross-boundary discussions with Walton Parish Council on Drakelow Park.

Drop-off point at JTHS

It will be important to continue to investigate this scheme and to engage with all appropriate stakeholders. The Parish Council will need to develop its strategic position on the issue, not only in respect of the opportunity for the school drop off area, but in terms of securing land for a cemetery, so that it is ready to respond when a planning application eventually comes forward.

ES has sent plans of the drop-off proposals to all relevant parties (Aggregate Industries, schools, SCC, agent for Lower Dunstall Estate, Cllr Julia Jessel), inviting them to a meeting about the proposal.  ES to push for meeting soon after forthcoming elections.

Conservation area

The Committee is keen to move forward on the development of a Management Plan for the conservation area. RB has drafted a letter to ESBC seeking its support for this Committee to undertake the task.  RB to send letter to Gerry Pack, with a recommendation to the full Parish Council to send it immediately to ESBC.

Topics for the Committee

ES had circulated a list of topics for the Committee to keep under review and consideration. It was agreed to add the consultation on the development of the next Local Transport Plan for Staffordshire from 2011 to the list.

At the next meeting, two key topics will be considered:
